These Terms govern your use of the Agano Children website and any donations, sponsorships or services you make through it. By using this site you agree to these Terms. If you do not agree, please do not use the site.

Acceptance of terms

By accessing or using this website you confirm that you are at least 18 years old or are using the site under the supervision of a parent or legal guardian, and that you accept these Terms together with our Privacy Policy.

Use of the website

You agree to use the site lawfully and respectfully, and not to:

  • Use the site in any way that breaks the law or infringes anyone's rights.
  • Attempt to gain unauthorised access to any part of the site, our systems or our data.
  • Upload viruses, malicious code or attempt to disrupt or overload the service.
  • Misrepresent the identity of a child, sponsor, donor or partner.
  • Scrape, copy or republish content without our written permission.

Accounts

If you create an account, you are responsible for keeping your credentials confidential and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

Donations & sponsorships

  • All donations and sponsorship payments are voluntary and are made to Agano Children in support of its charitable mission.
  • Donations are processed through regulated payment partners (e.g. Paystack). Agano does not store full card details on its servers.
  • Funds are applied to the programmes described, but Agano retains the discretion to allocate funds where the need is greatest, in line with our charitable purposes.
  • Sponsorship of a specific child does not create a legal guardianship, custody, contact right or any other parental or familial relationship. Communication with sponsored children, where offered, is facilitated through Agano under our child-safeguarding standards.
  • Photos, stories and updates we share are intended to illustrate the work of the programme; identifying details may be changed or withheld to protect a child's safety and dignity.
  • We may issue receipts or acknowledgements for donations. Tax deductibility depends on your jurisdiction and is your responsibility to confirm.

Refunds

Donations are generally non-refundable. If you believe a donation was made in error (duplicate, incorrect amount or unauthorised), please contact us within 14 days at info@aganochildren.org and we will review your request in good faith.

Intellectual property

All content on this website — including text, graphics, logos, photographs, videos and design — is owned by Agano Children or licensed to us, and is protected by copyright, trademark and other intellectual-property laws. You may view and share content for personal, non-commercial purposes with appropriate credit. Any other use requires our prior written permission.

User submissions

If you submit content to us (such as a message, testimonial or comment), you grant Agano a non-exclusive, royalty-free, worldwide licence to use, reproduce and adapt that content for the purposes of our charitable mission and communications. You confirm that the content is your own and does not infringe anyone's rights.

Third-party links

The site may link to third-party websites or services that we do not control. We are not responsible for their content, policies or practices. Visiting them is at your own risk.

Disclaimer

The site and all content are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability or availability of the site or its content.

Limitation of liability

To the fullest extent permitted by law, Agano Children, its trustees, employees and volunteers will not be liable for any indirect, incidental, consequential or special damages arising out of or in connection with your use of the site, including any loss of data, profits or goodwill. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

Indemnity

You agree to indemnify and hold harmless Agano Children from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your misuse of the site.

Governing law

These Terms are governed by the laws of the Republic of Kenya. Any dispute will be subject to the exclusive jurisdiction of the Kenyan courts, without prejudice to any mandatory protections available to you under the law of your country of residence.

Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the site after changes constitutes acceptance of the revised Terms.
